OVERVIEW

Welcome to Travel Wicks. Travel Wicks is a DBA of Shop In Today LLC. The terms "we," "us," and "our" refer to Travel Wicks and its parent company, Shop In Today LLC.

Travel Wicks operates this online store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Travel Wicks is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. They include important information about your legal rights and cover areas such as arbitration, warranty disclaimers, and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

NOTICE OF ARBITRATION

THESE TERMS OF SERVICE CONTAIN AN ARBITRATION PROVISION AND A CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. YOU HAVE A DUTY TO READ THIS AGREEMENT AND THE ARBITRATION PROVISION AND CLASS ACTION WAIVER CONTAINED WITHIN. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, THE ARBITRATION PROVISION, OR THE CLASS ACTION WAIVER, YOU MUST IMMEDIATELY DISCONTINUE YOUR USE OF THE SERVICES.

SECTION 1 — DEFINITIONS

"You" or "your" means the customer, purchaser, account holder, recipient, or any other person using the Services.

"We," "us," or "our" means Travel Wicks, a DBA of Shop In Today LLC, and any employee or representative thereof.

"Website" means www.travelwicks.com and all pages associated with that URL.

"Company" means Shop In Today LLC, operating under the DBA Travel Wicks.

"Services" means the Travel Wicks online store and website, including all related information, content, features, tools, products, and services.

SECTION 2 — ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide this information.

You may also create or access your account using a supported third-party login provider, such as Google. If you choose to do so, you authorize us to collect the profile information shared by that provider, including your name and email address, in accordance with our Privacy Policy. Your use of any third-party login service is also subject to that provider's own terms and conditions.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 3 — OUR PRODUCTS

We have made every effort to provide an accurate representation of our products and services in our online store. However, colors or product appearance may differ from how they appear on your screen due to the type of device you use to access the store and your device settings and configuration.

We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online store.

All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products we offer to any person, geographic region, or jurisdiction on a case-by-case basis.

SECTION 4 — PAYMENT TERMS

VISA, Mastercard, American Express, and Discover are accepted for all orders to customers in the USA. Your credit or bank statement will reflect a billing from TRAVEL WICKS. Shopify Payments is a Level 1 PCI Compliant processor that securely processes customer payments. If we do not receive payment from your credit card institution, you agree to pay all amounts due. If you place a chargeback and lose your claim, you are responsible for any costs incurred by us.

Travel Wicks is required to charge sales tax depending on regulations at your location. If required, this charge will appear on the order details screen prior to confirming the order. Currently we are required to charge sales tax on orders shipped to New York State.

You represent and warrant that: (i) the credit card information you provide is true, correct, and complete; (ii) you are duly authorized to use such credit card for the purchase; (iii) charges incurred by you will be honored by your credit card company; and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes.

SECTION 5 — ORDERS

When you place an order, you are making an offer to purchase. Travel Wicks reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Travel Wicks confirms acceptance. We must receive and process your payment before your order is accepted.

Travel Wicks utilizes an electronic shopping cart that generates automated order confirmations. This electronic confirmation does not constitute a binding seller agreement. All orders are reviewed by agents of Travel Wicks to confirm correct pricing, applicable taxes, and shipping charges. We reserve the right to accept or decline orders at any time for any reason. In the event Travel Wicks cannot fulfill an order based on the automated order confirmation, the customer payment will be refunded promptly.

Customers will be notified in any event that jeopardizes the delivery of an order. Please review your order carefully before submitting, as Travel Wicks may be unable to accommodate cancellation requests after an order is accepted.

Your purchases are subject to return or exchange solely in accordance with our Returns Policy at https://www.travelwicks.com/pages/returns.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 6 — PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, or handling charges.

Shipping costs are calculated at checkout based on your order and destination. Free shipping promotions, if offered, are subject to minimum order requirements and will be governed by the terms stated at the time of the promotion.

We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.

All previous orders do not qualify for any current sales, promotions, or special offers. Travel Wicks may make an exception for customers who have not yet received their order. Please contact Customer Service if you believe you qualify for an adjustment.

SECTION 7 — SHIPPING AND DELIVERY

Travel Wicks ships complete orders only. All products in an order must be available before shipment is initiated.

We ship to the contiguous 48 states. We do not currently ship to Alaska or Hawaii. We are unable to ship to PO Boxes or APO/FPO/DPO addresses.

Travel Wicks reserves the right to ship orders only to addresses that can be verified through our payment processor. To protect our customers and prevent fraud, we may require that your shipping address match the billing address on file with your credit card institution. We reserve the right to cancel or decline any order where billing and shipping address verification cannot be completed. We will not be able to honor requests for alternate shipping addresses via email, notes to merchant, or any other means outside of the designated address sections of the checkout process.

Travel Wicks cannot be held liable for any carrier in-transit shipping delays once an order has been accepted by the carrier for delivery. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers or events outside our control. Once we transfer your order to the carrier, title and risk of loss pass to you.

We may require a signature upon delivery for certain orders at our discretion.

We do not accept COD orders or local pickups.

International orders are not accepted at this time. We ship within the United States only.

Damaged Products

We must be notified within 5 days of delivery of any in-transit damage. Any damage must be noted on your incoming carrier's paperwork. You must comply with the carrier's procedures and documentation requirements to support processing of any claim.

Missing Products

We must be notified within 5 days of carrier delivery if there is a discrepancy between the packing list and the contents of the shipment. Please use our Contact Us form at https://www.travelwicks.com/pages/contact to resolve the issue promptly.

Package Delivered but Not Received

We must be notified within 5 days of the carrier's tracking showing delivery if a package cannot be found at the shipping address. Please use our Contact Us form at https://www.travelwicks.com/pages/contact.

Undelivered or Refused Orders

Orders returned to Travel Wicks due to refusal, failure to sign, incorrect address supplied by the customer, or multiple failed delivery attempts are not eligible for a refund of any shipping charges paid. If Travel Wicks provided complimentary shipping on the original order, the actual cost of that shipping will be deducted from any credit or refund issued. No refund will be processed until the physical product has been received and inspected by Travel Wicks. Orders that cannot be recovered and returned to Travel Wicks, including those delivered to an incorrect address as a result of customer-supplied address errors, are not eligible for a refund.

SECTION 8 — RETURNS AND CANCELLATIONS

Returns

Each Travel Wicks order is made specifically for you. We are not able to accept returns based on scent preference. If you are unsure about a scent before ordering, our FAQ at https://www.travelwicks.com/pages/faq has guidance on how to choose.

If your order arrives damaged or incorrect, please contact us at https://www.travelwicks.com/pages/contact within 5 days of delivery and we will make it right.

In exceptional circumstances, we may, at our sole discretion, accept a return of unused, unopened product. If such a return is approved, the following conditions apply:

  • Shipping charges paid by you at the time of the original order are nonrefundable.
  • Expedited shipping charges are nonrefundable under any circumstances.
  • If Travel Wicks provided complimentary shipping on the original order, the actual cost of that shipping will be deducted from your refund.
  • Products must be returned in unused, unopened condition. Any product that has been used or opened is not eligible for return.
  • No refund will be processed until the physical product has been received and inspected by Travel Wicks.
  • Approved refunds will be issued to the original form of payment only.

To request a return under these circumstances, contact us at cs@travelwicks.com to receive a Return Authorization number (RA#) and return shipping instructions. Returns cannot be accepted without a valid RA#.

Order Cancellation

Every Travel Wicks order is handcrafted to order. If you need to change or cancel your order, please contact us at https://www.travelwicks.com/pages/contact within 24 to 48 hours of placing your order. We cannot guarantee changes or cancellations once production has started. The sooner you contact us, the more we can do.

SECTION 9 — SECURE SHOPPING

We take protecting your information seriously. We and Shopify Payments utilize SSL (Secure Sockets Layer) to ensure safe, secure transactions. Shopify Payments is a Level 1 PCI Compliant processor. No one at Travel Wicks has access to your complete credit card information except the last four digits for order payment verification purposes.

Please be aware that email is not encrypted and is not a secure means of transmitting credit card information. Please do not include credit card numbers in any email to us.

SECTION 10 — INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Travel Wicks, its affiliates, or licensors and are protected by U.S. and foreign patent, copyright, and other intellectual property laws.

These Terms permit you to access the Services for personal shopping purposes only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Travel Wicks, Shopify, or any third party. Unauthorized use of the Services or any content therein may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Travel Wicks.

Travel Wicks's names, logos, product and service names, designs, and slogans are trademarks of Travel Wicks or its affiliates or licensors. You must not use such trademarks without the prior written permission of Travel Wicks. Shopify's name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

SECTION 11 — OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control or input over.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations, or conditions of any kind and without any endorsement. We have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider.

SECTION 12 — THIRD-PARTY LINKS

The Services may contain materials and hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third-party sites, you do so at your own risk.

We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review the third party's policies and practices carefully before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third party.

SECTION 13 — RELATIONSHIP WITH SHOPIFY

Travel Wicks is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Travel Wicks. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Travel Wicks, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Travel Wicks.

SECTION 14 — PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy at https://www.travelwicks.com/policies/privacy-policy and the supplemental Service Providers disclosure page available at https://www.travelwicks.com/pages/service-providers. Certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside. Review our privacy policy for more details on how we, Shopify, and our partners use your personal information.

SECTION 15 — FEEDBACK

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial use. We may use our rights under this license to operate, provide, evaluate, enhance, improve, and promote the Services.

You represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms. We are under no obligation to maintain your Feedback in confidence, to pay compensation for your Feedback, or to respond to your Feedback.

We may, but have no obligation to, monitor, edit, or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or that violates any party's intellectual property or these Terms of Service.

You agree that your Feedback will not violate any right of any third party, including copyright, trademark, privacy, personality, or other personal or proprietary rights. You further agree that your Feedback will not contain libelous or otherwise unlawful, abusive, or obscene material, or any computer virus or other malware. You are solely responsible for any Feedback you make and its accuracy.

SECTION 16 — ERRORS, INACCURACIES, AND OMISSIONS

Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information is inaccurate at any time without prior notice, including after you have submitted your order.

Travel Wicks reserves the right to update prices, product specifications, and policies without prior notice.

SECTION 17 — PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms; (g) to transmit or procure the sending of any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which may harm Travel Wicks, Shopify, or users of the Services, or expose them to liability.

In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code; (b) reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the Services; (e) use any robot, spider, scraping, data gathering or extraction tools, automatic devices or processes, AI tools (such as agentic AI), or automated or manual means to access the Services; or (f) interfere with, bypass, or circumvent the security or authorization features or other measures we employ to restrict access to the Services. We reserve the right to suspend, disable, or terminate your account at any time without notice if we determine that you have violated any part of these Terms.

SECTION 18 — AGENTS

18.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.

18.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in Section 18.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any Service.

18.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.

18.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans; (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer; and (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

SECTION 19 — PAYMENT DISPUTES

Travel Wicks wants to make sure you are satisfied with your order. If you notice a discrepancy on your financial statement, please notify Customer Service within 60 days of receiving your order. We will work with you to resolve any issues. Any credits or refunds issued by Travel Wicks will be applied to the original form of payment only. SECTION 20 — TERM AND TERMINATION

The term of this Agreement begins upon your first access to or use of the Website and continues until terminated by either party as set forth herein.

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, and any other provisions that by their nature should survive termination.

SECTION 21 — DISCLAIMER OF WARRANTIES

The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Services.

EXCEPT AS EXPRESSLY STATED BY TRAVEL WICKS, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

TRAVEL WICKS EXPRESSLY DISCLAIMS ANY RESPONSIBILITY FOR ANY DAMAGE, INJURY, HARM, COST, EXPENSE, OR LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OR MISUSE OF PRODUCTS PURCHASED THROUGH THE SERVICES.

SECTION 22 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL TRAVEL WICKS, SHOP IN TODAY LLC, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING BUT NOT LIMITED TO ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK AND THAT COMPANY'S LIABILITY IS LIMITED TO THE AMOUNT THAT YOU PAID FOR THE PRODUCTS OR $1,000, WHICHEVER IS LESS.

TRAVEL WICKS WILL NOT BE LIABLE TO YOU UNDER ANY LEGAL THEORY, WHETHER IN WARRANTY, CONTRACT, STRICT LIABILITY, TORT, OR NEGLIGENCE, FOR ANY DAMAGES, CLAIMS, INJURIES, JUDGMENTS, COSTS, OR LIABILITIES OF ANY KIND ARISING OUT OF OR RELATED TO YOUR USE OR MISUSE OF PRODUCTS PURCHASED THROUGH THE SERVICES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DAMAGE TO PROPERTY, LOSS OF BUSINESS, LOSS OF INCOME, SPECIAL DAMAGES, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, PUNITIVE DAMAGES, OR EXEMPLARY DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE. SOME JURISDICTIONS DO NOT ALLOW AN EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. IF YOU ARE LOCATED IN SUCH A JURISDICTION, THESE LIMITATIONS MAY NOT APPLY TO YOU.

SECTION 23 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Travel Wicks, Shop In Today LLC, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of: (1) your breach of these Terms of Service or the documents they incorporate by reference; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.

You and Travel Wicks agree that any dispute, claim, or controversy arising out of or in relation to your use of the Services, this Agreement, or the applicability, breach, termination, validity, enforcement, or interpretation thereof, will be settled by binding individual arbitration. If there is a dispute about whether this arbitration clause can be enforced or applies to the dispute between you and us, you and we agree that the arbitrator will decide that issue.

Notwithstanding the foregoing, you and Travel Wicks each agree that any claim related to actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights will not be subject to this arbitration clause. All claims related to actual or threatened infringement, misappropriation, or violation of intellectual property rights will be interpreted under New York law and will be heard exclusively in the state and federal courts located in Monroe County, New York.

You and Travel Wicks agree that the Federal Arbitration Act will govern the interpretation and enforcement of this arbitration provision. The arbitration will be administered under the American Arbitration Association's most recent Commercial Arbitration Rules then in effect, except as modified herein. The arbitration will be conducted in Monroe County, New York and will be decided by a single arbitrator randomly selected from a list of neutral arbitrators maintained by the American Arbitration Association. Judgment on any award rendered by the arbitrator may be entered in any court having jurisdiction. The arbitrator will be provided with the right to award costs and attorneys' fees to the prevailing party. Both parties agree that they will be required to be present in Monroe County, New York for arbitration under the terms of this Agreement and hereby submit to exclusive personal jurisdiction in Monroe County, New York. The arbitrator will apply the laws of the State of New York and the federal laws of the United States in deciding any controversy or claim.

You and Travel Wicks acknowledge and agree that each are waiving the right to a trial by jury as to all arbitrable disputes.

You and Travel Wicks acknowledge and agree that, to the fullest extent permitted under the law, each are waiving the right to participate as a plaintiff or class member in any class action lawsuit, class arbitration, or private attorney general action. If this class action waiver is held unenforceable with respect to the dispute between the parties, the parties agree that the entirety of this arbitration clause will be deemed void with respect to such dispute and the dispute must proceed in court.

SECTION 30 — CHANGES TO TERMS OF SERVICE

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website.
